Submittal Procedure
Purpose
In order to maintain the architectural character of the community, it is
necessary to provide more exacting guidelines than presented in the CC&Rs and
Bylaws of the Association. These guidelines have been established to
protect your investment and keep Los Verdes attractive to all residents.
Please note that no work may begin prior to Architectural approval.
Procedure
The Architectural Committee will review and respond to all plan submittals
within 45 days from the date of submittal. Homeowners shall present
drawings of any fence, landscaping or patio improvements, along with the Home
Improvement Form to the Architectural Committee for study and approval.
This
review is in no way intended to approve Architectural request for structural
engineering or in lieu of any required City/County permits or City/County
inspections. The intent is to maintain the visual continuity of Los
Verdes.
All
drawings shall be prepared in accordance with requirements for clarity and
completeness consistent with the requirements of the County/City Building
Departments and submitted to Los Verdes, care of its property management
company.
Required Copies
Present three (3) copies of the Home Improvement Form drawings, specifications
and color scheme to the Architectural Committee.
1.
One copy shall be retained by the Committee.
2.
One copy shall be returned to the owner with status of review.
3.
One copy shall be maintained with the Association records.
Application Fees
A payment of $200 (returnable deposit) plus an administration fee of
$25.00 to the Association is required to cover the cost of
evaluation.
Drawings
Plot Plan
a. Show exclusive use area boundary lines accurately as to length, angles
and curves.
b. Show all dimensions of work to be considered, such as distances between
existing improvements and exclusive easement lines.
c. Your blueprint/drawings must show the location of the bottom of any
slope and/or the top of the slope.
d. Drawings shall, in any case, show the nature, kind, shape, dimensions,
materials and location of the proposed improvements.
General Notes
1.
Color samples of all paint, stain or colored concrete are required.
2.
When construction work requires the use of adjoining exclusive use areas, the
applicant shall obtain written permission from the adjoining property owner.
A copy of this letter shall be filed with the request for architectural
approval.
3.
All work must be performed in a manner consistent with the standards of general
dwelling construction. All work considered to be of any unsightly finished
nature or of lesser quality than the prevailing community standards shall be
reworked to an acceptable appearance.
4.
All construction, alterations or other work shall be performed promptly and
shall be completed as designated by the Architectural Committee with a Notice of Completion
filed with the Architectural Committee.
5.
Each Homeowner is responsible for the cleanup of all construction debris as well
as for any damage to the driveways, curbs and/or gutters.
Appeal Procedure
In the event plans and specifications submitted to the Architectural Committee
are disapproved, the owner filing such application may appeal in writing to the
Board of Directors. The request must be received by the Board not more
than 30 days following the final decision of the Committee. Within 45 days
following receipt of the request for appeal, the Board shall render its written
decision. The Board may agree with the Committee and uphold the
disapproval, or the Board may disagree with the Committee and approve the plans.
Notice of Completion
Upon
completion of any work for which approval has been given, the owner shall submit
written notice of completion to the Committee. Within 60 days thereafter,
a representative of the Committee may inspect such improvement. If the
committee finds that such work was not done in substantial compliance with the
approved plans, it shall notify the owner in writing of such noncompliance
within a 60 day period and require the owner to correct the matter.
If upon
expiration of 30 days from the date of modification the owner has failed to
remedy the noncompliance, the committee shall notify the Board of Directors of
the Los Verdes Home Owners Association in writing of such failure. After
affording such owner notice and hearing, the Board shall determine whether there
is a non compliance of the CC&Rs and, if so, the nature thereof and the
estimated cost of correcting or removing the same within a period of not more
than 30 days fro the date announcement of the Board ruling of noncompliance.
If the owner does not comply with the Board ruling within such period, the Board
may levy a Compliance Assessment against such Owner for the costs of removing or
remedying such noncompliance.
All
construction, alteration or other work shall be performed promptly and
diligently as possible and shall be completed within 180 days after the date on
which the work commenced.
Variance
The Architectural Committee may authorize variances from the guidelines
contained herein provided that the variance is not detrimental to the community
and that the variance has been approved in writing by any Impacted Neighbor, as
defined in the Neighbor Notification section. The Architectural Committee
shall determine which neighbors are considered to be Impacted Neighbors for any
proposed variance.
Impacted Neighbor
It is
the intent of the Architectural Committee to consult neighbors on any
improvements which may impact heir use and enjoyment of their property.
Neighbor approval or disapproval of a particular improvement shall only be
advisory and shall not be binding in any way on the Architectural Committee's
decision.

Facing Neighbor, Adjacent Neighbor, and Impacted Neighbor
Facing
Neighbor:
means the 3 homes most directly across the street
Adjacent
Neighbor:
means all homes with adjoining property lines to the home in question
Impacted
Neighbor:
means all homes in the immediate surrounding area which would be affected by the
construction of any improvement
2.
Improvement Requiring Notification:
Any exterior improvements that may impact the neighbors in the community.
3.
Statement:
A Los Verdes Home Owners Association Facing, Adjacent and Impacted Neighbor
Statement must be provided to the Architectural Committee to verify the
neighbors have been notified about the proposed improvements.
